Mercedes-Benz India, the German car maker was involved in a legal battle for almost 12 years, charged for unfair means of trade by phasing out one of its car models. But now Mercedes can take a sigh of relief as it has been cleared of the accusations by national consumer commission.
Mercedes and its Indian partner Tata Engineering and Locomotive Co.(TELCO) , have cleared of the charges levied by Marine Container Services, based in Mumbai India. The National Consumer Dispute Redressal Commission has dismissed the charges against the firm. The complaint that was filed under the unfair means of trade practice stated that the car model which was sold to the buyer phased out a year ago.
NCDRC banished the complaint that rolling out a car model to a buyer just one year before it phased out and upgrading it with new car version can not be termed as unfair trade practices.
NCDRC bench of Justice R C Jain and member S K Naik stated that Mercedes Benz,Tata Engineering and Locomotive Co. (TELCO) were not planning an immediate launch of a new car model. The rolling out of a new car model after more than a year ago cannot be termed under the “immediate” category.
The companies are relived with the news, as the justice has been endowed to them. The German auto manufacturer enjoys a reputed name globally with the cars it develops. Mercedes has been gaining excellent response from the Indian auto market which has led the company time and again to invest in India. For 2010, the auto giant showcased a remarkable growth of 80 per cent which against the 2009's sales of 34250 car models.
